Can you walk Atlantic Avenue with a drink? Delray Beach open container rules

The short answer

No. Delray Beach, Florida City Code Section 113.02 bans drinking or carrying an open container on public streets, sidewalks, the beach and in parks. Seated patrons of a permitted sidewalk cafe are the exception. Section 113.15 stops alcohol sales from 2 AM to 7 AM, except Jan. 1, when closing runs to 4 AM. The beach bans alcohol and glass outright.

Atlantic Avenue has plenty of sidewalk cafe tables, and it is easy to assume a drink can come with you between them. The City of Delray Beach says otherwise. The rules sit in Chapter 113 of the City’s Code of Ordinances, which we read on Municode on Oct. 19, 2026. This page explains what the two key sections say, in plain words, and where the beach rules add more.

The short answer

No walking drinks on the street, sidewalk, beach or in a public park. Drink at your seat in a permitted sidewalk cafe. No alcohol sold or served from 2 AM to 7 AM (5 hours), except Jan. 1, when closing moves to 4 AM.

Section 113.02: the open container rule

City Code Section 113.02 makes it unlawful to drink alcohol or carry an open container of it in these places:

  • public streets, sidewalks and rights-of-way
  • the beach
  • public parks
  • motor vehicles

That covers the Avenue itself, the side streets and the walk from a restaurant to your car. The cup does not need to be glass for the rule to apply. An open container is enough.

  • City Code Section 113.02 makes it unlawful to drink alcohol or carry an open container on public streets, sidewalks and rights-of-way, on the beach, in public parks and in motor vehicles. Seated patrons of a permitted sidewalk cafe are an exception, as are attendees of Old School Square, Inc. events at Old School Square. The exceptions: sidewalk cafes and Old School Square events

Section 113.02 names two exceptions. The one most visitors will use is the permitted sidewalk cafe: a seated patron of a permitted sidewalk cafe may drink there. The key words are seated and permitted. The drink stays at the table you are served at. It does not travel down the sidewalk to the next place.

The second exception covers attendees of Old School Square, Inc. events at Old School Square. The code names the organization and the place. It does not cover the rest of downtown on the same night, and we found no published list of which events count, so ask the organizer at the gate. Our Old School Square guide covers the campus.

Section 113.15: when bars stop serving

City Code Section 113.15 bars selling or serving alcohol from 2 AM to 7 AM. That is a 5-hour window with no sales. On Jan. 1 the closing hour is extended to 4 AM, 2 hours later than the rest of the year. The code sets the latest time; each place sets its own hours inside it, so check the spot you plan to end at.

The beach: no alcohol and no glass

On the sand the rule is stricter. The City’s Parks FAQ says picnics are allowed on the beach, but glass containers, alcoholic beverages and barbecue grills or fires are prohibited. Section 113.02 also names the beach. There is no sidewalk cafe exception on the beach. Bring drinks in cans or plastic and leave the alcohol for dinner. The Delray Beach public beach guide has the rest of the beach rules.

What we do not cover

We do not give fine amounts, arrest rules or how the City enforces Chapter 113. Those are matters for the City and the courts, and the full text is on Municode. The rules above are the City’s, as worded in facts we checked on Oct. 19, 2026. They are not legal advice.
